The applicants have filed this application for quashing the F.I.R., charge sheet and R.C.C. No.2169/2024 arising out of Crime No.439/2023 for the offence punishable under Sections 498-A, 323 504 and 506 read with Section 34 of I.P.C.

The applicants are the husband and mother-in-law of the non-applicant No.2.

During the pendency of this application, the matter is settled between the parties. The consent terms are filed on record. Non-applicant No.2 has agreed to obtain divorce by mutual consent and is ready to withdraw all the litigations filed against the applicants.

The applicant No.1 is present through V.C.

The non-applicant No.2 is present before this Court and she has stated that she is willingly withdrawing this application as she has filed petition for divorce by mutual consent. She has waived her maintenance right and Stridhan also. As the non-applicant No.2 has no grievance against these applicants and as per the consent terms she is withdrawing the F.I.R. lodged against these applicants, the

apl963.2026.odt F.I.R., charge sheet and R.C.C. No.2169/2024 filed against these applicants is quashed and set aside.

The applicants to pay the costs of Rs.30,000/- with the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No.129712010001014 and IFSC Code UBIN0812978 and producing the receipt thereof on record within two weeks.
