Mr. A.D. Ramteke, waives notice for the non-applicant No.2. 5.
The applicants have filed this application for quashing of F.I.R. in Crime No.806/2025, registered by the non-applicant No.1, for the offence punishable under Sections 308(2), 308(3), 111 and 3(5) of the Bhartiya Nyaya Sanhita, 2023 (BNS).
6.
The allegations are made that these applicants used to demand Rs.2,000/- to release the vehicle from Pandharkawda (Patan Bori) to Andhra border and thereafter they started demanding Rs.4,000/- per vehicle. Therefore, the non-applicant No.2 has lodged the complaint against all the applicants and the crime is registered. 7.
The matter is settled between the parties. The non-applicant No.2 is present before the Court. He has filed an affidavit stating that he has commercial transactions with the applicants and due to some
apl1026.2026.odt misunderstanding, he has lodged the complaint. Now, he has no grievance against all the applicants and he does not want to proceed further and has no objection to quash the F.I.R. registered against these applicants. The applicants are also present before the Court. 8.
As the non-applicant No.2 has filed an affidavit on record stating that he has no objection to quash the F.I.R. against these applicants, the F.I.R. in Crime No.806/2025 for the offence punishable under Sections 308(2), 308(3), 111 and 3(5) of BNS is quashed and set aside subject to applicants' depositing costs of Rs.20,000/- each with Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No.129712010001014 and IFSC Code UBIN0812978 and producing the receipt thereof on record within three weeks.. 9.
