The applicants have filed this application for quashing criminal proceedings and First Information Report (FIR) registered against them for offences punishable under Section 498-A read with Section 34 of the Indian Penal Code.

During pendency of this application, the matter is settled between the parties. They have filed petition for divorce. The applicants are going to deposit DD of Rupees One Lakh before the Family Court and remaining amount will be delivered to non-applicant no. 2 as per terms and conditions agreed between the parties. 4.

Non-applicant no. 2 is present before the Court. She has stated that she has no grievance against the applicants and they have filed the divorce petition by mutual consent and has no objection to set aside the FIR registered against the applicants.

In view of the pursis and affidavit filed by nonapplicant no. 2 on record, FIR No. 154/2023 registered by non-applicant no. 1 and proceedings viz. R.C.C. No. 3855/2023 pending before the JMFC Court, Nagpur are quashed and set aside subject to costs of Rs. 10,000/- to be paid by the applicants jointly and non-applicant no. 2 separately to the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No. 129712010001014 and IFSC Code UBIN0812978 and to produce the receipts thereof on record within two weeks.

The application stands disposed of.
