The applicants have filed this application to quash and set aside the Charge-sheet being RCC No. 4342 of 2023 pending on the file of Add. Chief Judicial Magistrate, Nagpur, and the First Information Report No.116 of 2023 registered with police station Jaripatka, Nagpur for the offence punishable under Section 498-A r/w 34 of the Indian Penal Code.

The complaint has been lodged by Non-Applicant No. 2, and the crime is registered against the applicant No.1 as well as his family members. During the pendency of the present application, the parties have amicably settled the dispute. The applicant and Non-Applicant No. 2 have mutually agreed to dissolve their marriage by way of mutual

2 / 3 25-25-apl- 1079-26 consent, and the consent terms have been placed on record. 4.

In terms of the settlement, Non-Applicant No. 2 has received a sum of 11,00,000/- towards full and final ₹ settlement of permanent alimony, for which a demand draft has been duly handed over to her. It is further stipulated in the consent terms that Non-Applicant No. 2 shall withdraw all pending cases instituted against the applicant and his family members.

5. The applicant and the non applicant no.2 are present before the Court today. Non applicant No.2 has stated that she has no objection to quash and set aside the Charge-sheet and the FIR filed against the applicants. She has no grievance against the present applicants.

6. As the non applicant no.2 has no objection and the mater is settled between the parties, Charge-sheet being RCC No. 4342 of 2023 pending on the file of Add. Chief Judicial Magistrate, Nagpur, and the First Information Report No.116 of 2023 registered with police station Jaripatka, Nagpur for the offence punishable under Section 498-A r/w 34 of the Indian Penal Code are hereby quashed and set aside only subject to the applicants depositing Rs.10,000/- and the Non- applicant No.2 depositing Rs.10,000/- with the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No.129712010001014 and IFSC Code UBIN0812978 and producing the receipt thereof on record

The application is allowed in the above terms and disposed of.
