The applicant has filed this application to quash and set aside the Charge-sheet being SCC No. 822 of 2025 pending on the file of Judicial Magistrate First Class, Kamptee, arising out First Information Report No.181 of 2024 registered with police station Kamptee, District, Nagpur for the offence punishable under Sections 327, 342, 451, 323, 504 and 506 r/w 34 of the Indian Penal Code.
3. The allegations are that the non-applicant No. 2 married one Gulam Gaus Pathan, and the applicant is the son of the said Gulam Gaus Pathan. The applicant is the stepson of non-applicant No. 2. After the marriage of Gulam Gaus Pathan with non-applicant No. 2, domestic quarrels
2 / 3 28-apl 1082-26 used to take place between them, and therefore, nonapplicant No. 2 went to reside with her mother. Thereafter, the crime came to be registered against the applicant. 4.
During the pendency of this application, the matter has been settled between the parties. The applicant (son) and non-applicant No.2 (stepmother) are now residing together. Non-applicant No.2 is present before the Court today. She has stated that she has no objection if the chargesheet filed against the applicant is quashed and set aside. She has further stated that she has no grievance against the present applicant.

As the non applicant no.2 has no objection and the mater is settled between the parties and the applicant and the non applicant No.2 are staying happily, SCC No. 822 of 2025 pending on the file of Judicial Magistrate First Class, Kamptee, arising out First Information Report No.181 of 2024 registered with police station Kamptee, District, Nagpur for the offence punishable under Sections 327, 342, 451, 323, 504 and 506 r/w 34 of the Indian Penal Code is hereby quashed and set aside, only subject to the applicant depositing Rs.10,000/- with the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No.129712010001014 and IFSC Code UBIN0812978 and producing the receipt

6. The application is allowed in the above terms and disposed of.
