By this application, the applicant/appellant is seeking suspension of sentence.

It is contention of learned counsel for the applicant that the applicant has been convicted by learned Additional Sessions Court, Niphad, Nashik, for the offence punishable under Section 341 of the Digitally signed by SHUBHADA SHANKAR KADAM Date:
2026.01.08 17:21:20 +0530 SHUBHADA SHANKAR KADAM Indian Penal Code 1860 and sentenced to suffer maximum punishment of
3 (three) years rigorous imprisonment and to pay fine of Rs.50,000/-. The applicant has deposited part fine amount of Rs.10,000/. Learned counsel further submitted that during the trial, the applicant was on bail, he has not misused the liberty.

Learned APP for the Respondent No.1- State strongly objected to allow the application on the ground that if the applicant is released on bail, he may abscond and, therefore, requested to reject the application. 5.
I have heard both learned counsel and perused the impugned judgment and order. The conviction imposed is a short term sentence. During the trial, the applicant was on bail and he has not misused the liberty. It may take some time to dispose of the appeal. 6.
In view of above, the applicant's sentence is suspended and he is enlarged on bail, pending the hearing and final disposal of the appeal, on the following terms and conditions.
ORDER
i) The applicant be enlarged on bail on furnishing P.R.Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
ii) The applicant shall pay remaining fine amount within two weeks from today.

Interim Application is allowed in the aforesaid terms and is accordingly disposed of.
