CORAM : MRS. VRUSHALI V. JOSHI, J.

DATED : FEBRUARY 12, 2026 P.C.:

1.

The applicant has filed the present interim application seeking relaxation of bail conditions in connection with C.R. No. 244 of 2018 registered with Pandharpur City Police Station, Solapur, for offences punishable under Sections 302, 303, 120-B, 201, 143, 147, 148 and 149 of the Indian Penal Code, Sections 3, 4, 5, 25 and 27 of the Arms Act, 1959, Section 135 of the Maharashtra Police Act, and Sections 3(1)(i), 3(1)(ii), 3(2) and 3(4) of the Maharashtra Control of Organised Crime Act, 1999.

While granting bail, vide order dated 13th June 2025, this Court imposed, inter alia, a condition that:

"C] The applicant shall not enter into the limits of Districts - Pune and Solapur except to attend the dates before the trial Court till conclusion of the trial".

3.

Learned counsel for the applicant submitted that the applicant had contested the election for the post of Corporator and was elected. During the election period, the said condition was relaxed for a period of 40 days. Now that the applicant has been elected, it is necessary for him to enter District Solapur. He further submitted that the mention of District Pune in the bail conditions is inadvertent, as there is no material on record requiring the applicant to be restrained from entering Pune. 4.

Learned APP vehemently opposed the application and prayed for its rejection.

5.

As the applicant has been elected and is now a Corporator of Pandharpur, Condition No. 'C' of the operative part of order dated 13th June 2025, restraining him from entering Districts Solapur and Pune, is relaxed.

6.

The interim application stands disposed of.
