The Applicant has challenged the judgment of conviction. The Applicant has been convicted for the offence punishable under Section 353 of the Indian Penal Code and sentenced to suffer simple imprisonment for one year and to pay a fine of Rs.2,000/-, in default to suffer simple imprisonment for one year.

For the offence punishable under Section 427 of the Indian Penal Code, the Applicant has been sentenced to suffer simple imprisonment for six months and to pay a fine of Rs.1,000/-, in default to suffer simple imprisonment for fifteen days. Suresh 1/2

For the offence punishable under Section 3 of the Prevention of Damage to Public Property Act, the Applicant has been sentenced to suffer simple imprisonment for one year and to pay a fine of Rs.2,000/-, in default to suffer simple imprisonment for one year. 4.

As the Applicant has preferred the present Appeal, the substantive sentences of imprisonment is suspended. Interim Application is allowed. During the pendency of the Appeal, the Appellant is ordered to be released on bail on appropriate terms and conditions.
