This is an application for modification of condition (d) imposed by order dated 7th October 2023, passed in Bail Application No.32 of 2023, whereby the Applicants were directed to attend the Investigating Officer of Virar Police Station once in two months i.e. on first Monday of every alternate month between 10:00 a.m. and 12:00 noon commencing from November, 2023. 2.
Learned counsel for the Applicants submits that for the last two and half years the Applicants have attended the concerned Police Station. According to her, there is no propriety in continuing with the said condition anymore.

Learned APP opposed the application.

Even if it is accepted that the trial is in progress, the question arises as to what would be the purpose for continuing the said condition henceforth. There was no proper reason put forth by the prosecution in continuation of the said condition. 5.
There is no allegation against the Applicants that they breached any of the conditions of bail order. Hence, condition (d) stands deleted.

In case the Investigating Officer finds any interference at the hands of the Applicants in the evidence of the prosecution, it is open for him to issue notice in writing to the Applicant for their appearance before him.
7.
The Applicants shall attend the police station if notice is so issued in writing.
8.
Interim Application stands allowed of in above terms and is disposed of.
