By this Application the Applicant is seeking return of the passport for the purpose of travelling abroad for pilgrimage to Iraq from 11.02.2026 to 29.03.2026. 2.

Learned counsel for the Applicant submits that the Applicant wants to travel for pilgrimage to Iraq from 11.02.2026 to 29.03.2026. Earlier the Applicant was permitted to travel abroad. The Applicant undertakes to redeposit the passport with the Registry of the City Civil &

(P.A.) 906_IA_57_2026.doc Sessions Court, Mumbai and requested to allow the Application.

Learned APP strongly objected to allow the Application on the ground that Applicant is NRI. If Application is allowed, he may abscond and requested to reject the Application.

I have heard both the learned counsel. The Applicant intends to travel for pilgrimage to Iraq and intends to travel from 11.02.2026 to 29.03.2026. He undertakes that after returning from Iraq, he will deposit the passport with the Registry of City Civil & Sessions Court, Mumbai. Considering these facts, I pass following order:-

ORDER

(i) The Application is allowed.

(ii) The Registry of the City Civil & Sessions Court, Mumbai is directed to return the passport to the Applicant.

(P.A.) 906_IA_57_2026.doc (iii) The Applicant shall furnish his detailed itinerary, including the details of travel tickets, the hotel at which he will be staying in Iraq, contact details that will remain operational during his visit abroad, and any other details as may be required by the Investigating Officer, prior to leaving the country.

(iv) The Applicant shall file undertaking before the Registrar City Civil & Sessions Court, Mumbai that he will deposit the passport after returning from Iraq.

Interim Application is disposed of.

Parties shall act on an authenticated copy of this order.
