Learned Counsel for the Applicants submits that the Applicants have undergone more than 10 years of incarceration and that the present Application is being pressed on that ground, particularly in the light of judgment of the Supreme Court in the case of Saudan Singh vs. State of Uttar Pradesh1. It is brought to our notice that two co-accused persons were granted bail on this very ground by an order dated 4th October 2025 1 2022 SCC OnLine SC 697 Purti Parab
903-APEAL-31-2025 @ ORS.DOC passed by a Division Bench of this Court (Coram : A.S. Gadkari and Ranjitsinha Raja Bhonsale, JJ).

It is also brought to our notice that Interim Application No. 4753 of 2025 in Appeal No. 1191 of 2025 arising from the same common impugned judgment and order of the Trial Court is also pending wherein the Applicants are pressing for bail on the aforesaid ground. 3.
It would be appropriate that the Learned APP calls for a certificate from the jailer with regard to the period of incarceration undergone by the Applicants in both the above referred applications so that the applications can be taken up together for consideration. 4.
List this Interim Application along with Interim Application No. 4753 of 2025 in Appeal No. 1191 of 2025 on 4th February 2026 in the Supplementary List.
