The Applicant has challenged the order passed by the trial Court convicting the Applicant/Appellant for the offences under Section 304 and 283 of Indian Penal Code and Section 177 of the Motor Vehicle Act, 1988.

For the offence punishable under Section 304 of the Indian Penal Code, the Applicant has been sentenced to suffer rigorous imprisonment for 3 years and to pay fine of Rs.3,000/- and in default to suffer simple imprisonment for one month. For the offence Gaikwad RD 1/2

905-ia-115-2026.doc punishable under Section 283 of the Indian Penal Code, the Applicant has been imposed to pay fine of Rs.200/-. For the offence punishable under Section 177 of the Motor Vehicle Act, 1988, the Applicant has been imposed to pay fine of Rs.500/-. 3.

As the Applicant is sentenced for 3 years rigorous imprisonment, he has filed this application to suspend the sentence during the pendency of appeal filed by the Applicant. 4.

As during pendency of trial, the trial Court has released the Applicant on bail, the sentence imposed on the Applicant is suspended and he is released on bail, which was already granted, on the terms and conditions, which are imposed by the trial Court. 5.
