The Applicant has preferred the present Application seeking suspension of sentence.

The Appellant was arrested in connection with the offence punishable under Section 363 of the Indian Penal Code and has been sentenced to suffer rigorous imprisonment for a period of three years and to pay a fine of Rs. 10,000/-, in default of payment of fine to undergo simple imprisonment for four months.

The Appellant has been acquitted of the offences punishable under Sections 8 and 12 of the Protection of Children from Sexual Offences Act and Section 366-A of the Indian Penal Code. Thus, the conviction survives only in respect of the offence punishable under Section 363 of the Indian Penal Code, for which he has been sentenced as stated above.

During the pendency of the Appeal, the Applicant has sought suspension of the order of conviction and sentence. The Appellant is already on bail. It is prayed that the sentence be suspended and that the Appellant be released on bail on appropriate terms and conditions pending disposal of the Appeal. Application is allowed. 5.

Issue notice to the Respondents in Appeal, returnable on 27th March 2026.
