1) By an Order dated 13th June 2025, in Interim Application No.1471 of 2025 in Criminal Appeal No.259 of 2020, Applicant was granted temporary bail for a period of 6 months from 16th June, 2025. The said period has come to an end today.

KSG 18-IA-191-2026.doc 2) Applicant is convicted for offences punishable under Sections 376 and 376(2)(n) of the Indian Penal Code, 1860 and under Sections 4, 5(jii), 5(l) and 6 of the protection of Children from Sexual Offences Act, 2012. The offence alleged against the Applicant is a heinous crime. 3) It is the contention of the Applicant that, he is suffering from ischemic heart disease post coronary angioplasty with left ventricular ejection fraction 30-35% along with Type 2 Diabetes mellitus with history of poor control with left lower limb varicose vein disease. 3.1) It is the lawful duty of the State to provide medical treatment to the Applicant being in judicial custody of the State. 4) In view thereof, learned Advocate for the Applicant submitted that, Applicant will surrender to the jail Authority i.e. Amravati Central Prison, Dist. Amravati on or before 05:00 p.m. of 23rd January, 2026. The said statement is accepted.
5) As noted earlier, it is the lawful duty of the State to provide all medical treatment for the element being suffered by him to the Applicant. We therefore direct the Superintendent, Amravati Central Prison, to provide all the necessary and medical treatment to the Applicant after he surrenders to the jail Authority.
6) It is needless to mention that, the said treatment shall be at the cost of Government, unless and until the applicant volunteers to pay the amount towards the medical treatment in a private hospital of his choice. 2/3
KSG 18-IA-191-2026.doc 7) The Superintendent, Amravati Central Prison, Amravati is directed to refer the Applicant to the Department of Cardiology Regional Reference Services, Hospital Amravati, immediately on the next day, after he surrenders to the jail Authority.
