INTERIM APPLICATION NO.195 OF 2026 1.

Heard Mr. Pawar, learned Counsel appearing for the Applicant and Mr. Yadav, learned APP, for the Respondent-State. 2.

By the present Interim Application, the Applicant is seeking condonation of delay of 2817 days in iling the Appeal. However, perusal of the Interim Application shows that the impugned Judgment and Order of the learned Sessions Court is dated 26th April 2018. The Applicant had challenged the said Judgment and Order of conviction and sentence by iling a common Criminal Appeal No.907 of 2018 along with other Co-Accused. However, by iling Interim Application No.1312 of 2023, the Applicant prayed for leave to ile a separate and independent Appeal. By Order dated 22nd June 2023 passed in the said Interim Application No.1312 of 2023 in Criminal Appeal No.907 of 2018, the said request was allowed. Pursuant to the said Order, the present Interim Application has been been iled on 13th March 2026. 3.

Mr. Pawar, learned Counsel for the Applicant, submits that the separate Appeal could not be iled earlier as the Applicant was behind the bars and was unable to arrange the necessary documents and expenses required for iling the Appeal.

Accordingly, in the facts and circumstances, the Interim Application is allowed in terms of prayer clauses (A) and (B) and is disposed of.

CRIMINAL APPEAL (STAMP) NO.1109 OF 2026 5.

Admit.

To be heard along with Criminal Appeal No.907 of 2018. INTERIM APPLICATION NO.196 OF 2026 7.

This Interim Application seeking bail during the pendency of Appeal be listed on 15th April 2026.
