1) This is an Application for modification of condition No. (c) of Order dated 30th July 2024, passed in Criminal Appeal No. 1267 of 2023. Condition No. (c) of the said Order reads as under :- "(c) The Appellants shall attend ATS Kalachowki, Mumbai on first Monday of every month between 10.00 a.m. to 12.00 noon."
2) Learned Advocate for Applicant submitted that, the Applicant is ordinarily resident of Belgaum, State of Karnataka and it is very difficult for him to travel to Mumbai every month for marking his attendance. He 1/2
DTG 7-Ia-203-2026.doc submitted that, the Applicant is also an accused in a crime registered at Rajarampuri Police Station, Kolhapur and therefore the Applicant may be permitted to mark his presence in the present crime at Rajarampuri Police Station, Kolhapur itself.
3) Learned APP on instruction from Mr. Anil Shewale, ACP, ATS, Pune, submitted that, concerned Officer has no serious objection for the said modification.
4) In view thereof, the condition No. (c) of Order dated 30th July 2024 is modified and the Applicant is hereinafter directed to attend the Rajarampuri Police Station, Kolhapur, on every Tuesday in the second week of every month between 10.00 a.m. and 12.00 noon. 5) Rest of the conditions of Order dated 30th July 2024 imposed upon the Applicant while releasing him on bail are maintained. 6) Application is allowed in the aforesaid terms.
