1) This is an Application for modification of condition No. (iv) of Order dated 19th September 2024, passed in Criminal Appeal No. 589 of 2024. Condition No. (iv) of the said Order reds as under :- "(iv) The Appellants shall attend ATS Kalachowki, Mumbai on first Monday of every month between 10.00 a.m. to 12.00 noon." 2) Learned Advocate for Applicant submitted that, the Applicant is an ordinary resident of Indira Naggar Sakali, Taluka Yawal, District Jalgaon and it is very difficult for him to travel to Mumbai every month for marking his attendance. He submitted that, the Applicant is also an accused in a crime 1/2
DTG 25-Ia-204-2026.doc registered at Rajarampuri Police Station, Kolhapur and therefore the Applicant may be permitted to mark his presence in the present crime at Rajarampuri Police Station, Kolhapur itself.
3) Learned APP on instructions from Mr. Mohan Dongre, ATS, Nashik, submitted that, the prosecution has no serious objection for the said modification.
4) In view thereof, the condition No.(iv) of Order dated 19th September 2024 is modified and the Applicant is hereinafter directed to attend the Rajarampuri Police Station, Kolhapur, on every Tuesday in the second week of every month between 10.00 a.m. and 12.00 noon. 5) Rest of the conditions of Order dated 19th September 2024 imposed upon the Applicant while releasing him on bail are maintained. 6) Application is allowed in the aforesaid terms.
