Heard Mr. Sanjeev Kadam, Senior Advocate for the Applicant and Ms. Anagha Deshmukh, learned APP for the State. 2.

By the present Application, the Applicant has sought for the following substantive reliefs in terms of prayer clause (a) :-

a. Be pleased to allow the present Application and relax the condition Nos. "c" and "d" imposed by this Hon'ble Court (Coram: Shri N. R. Borkar, J) vide order dated 29th September, 2025 while allowing the Anticipatory Bail Application No.2668 of 2025 and direct the Respondent Police officer to return the Passport of Applicant. 3.

By order dated 29th September, 2025, the Applicant was granted pre-arrest bail in Crime No. 603 of 2025, registered at Wagle Estate Police Station, for offences punishable under Section 69 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Condition No. (d) reads as follows:

"d) The Applicant shall deposit his passport with the concerned police Station."

Mr. Sanjeev Kadam, learned Senior Advocate for the Applicant, submits that the occasion for seeking relaxation of Condition No. (d) of the order dated 29th September, 2025 is the Applicant's need to travel abroad.

Ms. Anagha Deshmukh, learned APP for the State opposes this Application. She however submits that in the event the Applicant intends to travel abroad, an additional condition be imposed as a bail condition to the effect that the Applicant should seek prior permission to travel abroad from the Sessions Court,

Thane, which request can be appropriately considered by the Sessions Court, Thane.

Mr. Sanjeev Kadam, learned Senior Advocate for the Applicant, agrees to the modification of the order dated 29th September, 2025, passed in Anticipatory Bail Application No. 2668 of 2025, by adding the condition suggested by Ms. Anagha Deshmukh, learned APP for the State. He submits that if the condition requiring prior permission for travel is added in the bail order dated 29th September 2025, the Applicant will file an appropriate Application before the Sessions Court, Thane, seeking permission to travel.

At the request of Mr. Sanjeev Kadam, learned Senior Advocate for the Applicant and by consent of Ms. Anagha Deshmukh, learned APP the order dated 29th September, 2025, passed in Anticipatory Bail Application No. 2668 of 2025 shall stand modified by addition of Condition no ( e ) which reads as follows :- "e) The Applicant shall not leave the country without

prior permission from the Session Court ."

The rest of the order dated 29th September, 2025, passed in Anticipatory Bail Application No. 2668 of 2025 remains unaltered.

Mr. Sanjeev Kadam, learned Senior Advocate, states that this Application be disposed of, as the Applicant now has the option to apply to the Sessions Court, Thane, for permission to travel.

Interim Application No. 210 of 2026 is disposed of in the above said terms.
