Heard learned counsel for the Applicant, learned APP and learned counsel for Respondent No.2.

Both learned counsel submit that, parties have settled the matter out of the Court and tendered the Consent Terms, it is taken on record and marked 'x' for identification.

The Respondent No.2 present in Court, this Court inquired with him about terms mentioned in the Consent Terms. He agreed the same.

The learned counsel for the Applicant submit that, the Applicant is behind bar, as the matter is settled the Applicant be released on bail and matter be disposed of.

Considering the submission of both learned counsel and in view of the Consent Terms, I pass following order.
ORDER
(i) The Application No.216 of 2026 is allowed.
(ii) The sentence imposed on the Applicant is suspended. (iii) The Applicant be released on bail in Criminal Appeal No.356 of 2016 pending before Sessions Court, Mumbai on furnishing PR bond of Rs.15,000/- only.
(iv) The bail bonds to be furnished before Sessions Court. 6.
In view of the settlement of the matter Revision Application No.34 of 2026 is allowed.

The Applicant is acquitted from the charges levelled against him. 8.
All pending Applications are disposed of.
