Heard Ms. Kirthika, learned Advocate for the Applicant/Complainant, Mr. Veerdhaval Kakade, learned Advocate for the Petitioner and Ms. Pallavi Dabholkar, learned A.P.P. for the State/Respondent.

By Criminal Writ Petition No. 3605 of 2025, the Petitioner has sought for the following substantive relief in terms of prayer clause 9(a) :- "a) This Hon'ble Court be pleased to quash and set aside
the impugned order dated 17.08.2024 passed by the Learned Session Court, Pune below Application at Exh.51 in Criminal Appeal No. 112 of 2021 and cancel the Non-Bailable Warrant against the present Petitioner."

By the present Interim Application, the Applicant/Complainant has sought for the following substantive relief in terms of prayer clause 8(a) :- "a) This Hon'ble Court may allow the Applicant to withdraw the amount of Rs. 20,75,818/- deposited before the District and Sessions Court, Pune in Criminal Appeal No. 112 of 2021 along with interest accrued thereon." 4.
Mr. Veerdhaval Kakade, learned Advocate for the Petitioner and Ms. Kirthika, learned Advocate for the Applicant/Complainant submit that the Criminal Writ Petition can be disposed of in view of the order dated 19.09.2024, passed by this Court in the said Writ Petition. They submit that the order dated 19.09.2024 is complied and compliance is recorded in the orders dated 27.09.2024 & 12.11.2024.

Mr. Veerdhaval Kakade submits that Criminal Writ Petition No. 3605 of 2025 stands worked out in view of the above referred orders. He submits that this Petition be disposed of and if the Applicant/Complainant intents to file any Application before the Trial Court seeking withdrawal of the amount deposited in Court, subject to the legal objections of the Petitioner, the same be considered by the Trial Court.

Ms.
Kirthika, learned Advocate for the
Applicant/Complainant agrees to the said suggestion. She states that the Applicant/Complainant in Interim Application No. 217 of 2026/Respondent No. 2 in the said Petition would file an Application before the Trial Court requesting for withdrawal of the amount. If such Application is filed by Respondent No. 2 before the Trial Court, the same be considered on its own merits after affording an opportunity of hearing to the parties and in accordance with law.

Criminal Writ Petition No. 3605 of 2025 is disposed of in the above said terms.

In view of disposal of the said Petition, Ms. Kirthika, learned Advocate for the Applicant/Complainant craves leave to withdraw Interim Application No. 217 of 2026 with liberty to file a fresh Application before the Trial Court.

Ms. Pallavi Dabholkar, learned A.P.P. does not object for grant of liberty. In view of No Objection, liberty as prayed by Ms. Kirthika is granted.

Needless to mention that in view of the deposits made by the Petitioner, the impugned order dated 17.08.2024, issuing NonBailable Warrant is set aside. 11.
Interim Application No. 217 of 2026 is disposed of as withdrawn with liberty as prayed.
