The Applicant seeks relaxation of clause (c) of paragraph 10 of the order dated 11th October 2023 passed by a co-ordinate Bench of this Court. Clause (c), which is sought to be modified reads thus:

"(c) The applicant shall attend the Investigating Officer of CBD Belapur Police Station, Navi Mumbai once in a month every first Monday of the month between 11.00 a.m. and 1.00 p.m."

Heard Ms. Waqar Pathan, learned counsel for the Applicant and Ms. Gauri Rao, learned APP.

Mr. Pathan submits that te Applicant has been attending the Trial Court as well as the Investigating Officer regularly and diligently as per the condition imposed on him by this Court. In support thereof, he has annexed acknowledgments issued by the concerned police station evidencing his attendance. He further submits that the charges are not yet framed before the Trial Court.

Considering the reasons mentioned in the Application as well as the submissions made on behalf of the Applicant, I am inclined to relax condition (c) of paragraph 10 of the order dated 11th October 2023, which shall read as under: "(c) The Applicant shall attend the Investigating Officer of CBD Belapur Police Station, Navi Mumbai once in every three month, on the first Monday of the third month, between 11:00 a.m. and 1:00 p.m." 5.

Rest of the order remains as it is.

The Interim Application is allowed and disposed of in the aforesaid terms.
