The Applicant seeks modification of condition (A) of the order dated 20th September 2024. The condition sought to be modified reads thus:

"(A) The applicant shall be released on bail in connection with FIR No.231 of 2019, registered on 06.03.2019 at Police Station Malvani, Mumbai, on furnishing PR bond of 25,000/- and one or two ₹ sureties in the like amount to the satisfaction of the Trial Court."

Heard Ms. Shaila Zende, learned counsel for the Applicant and Ms. Anuja Gotad, learned APP.

Considering that the Applicant is incarcerated from 6 March 2019 and despite grant of bail by order dated 20th September 2024, is unable to secure his liberty only because of lack of funds, I am inclined to modify the said condition. The modified condition shall read thus:

"The Applicant shall be released on bail in connection with FIR No.231 of 2019, registered on 6th March 2019 at Police Station Malvani, Mumbai on furnishing cash bail of Rs.5,000/-"

Rest of the conditions remain as it is.

The Interim Application is allowed and disposed of accordingly.
