C. :- 1) This is an Application for condonation of delay of 1309 days, by the original accused no.3, in preferring Appeal against conviction. 2) Heard Mrs. Potdar, learned Advocate appointed to represent the Applicant/Appellant and learned APP for the State. 3) Record indicates that, since the date of his arrest the Applicant was behind bars and on the date of pronouncement of the impugned Judgment, for want of legal and financial assistance he could not prefer an Appeal within the period of limitation. That, after the Applicant preferred an Application with the High Court Legal Services Committee, Mumbai, present Advocate was appointed to represent him. The learned Advocate 1/2

In this entire process, the said delay of 1309 days has occurred. 4) In view of the above, for the reasons stated in the Application and in the interest of justice, the said delay is condoned and Application is allowed in terms of prayer clause 6(1).
