C. :- 1) This is an Application for condonation of delay of 1309 days, by the original accused no.3, in preferring Appeal against conviction. 2) Heard Mrs. Potdar, learned Advocate appointed to represent the Applicant/Appellant and learned APP for the State. 3) Record indicates that, since the date of his arrest the Applicant was behind bars and on the date of pronouncement of the impugned Judgment, for want of legal and financial assistance he could not prefer an Appeal within the period of limitation.
