The present application is filed seeking suspension of sentence imposed by the learned Sessions Court, Sangli, in Sessions Case No.86 of 2018 by judgment dated 29/05/2026 as per Section 258(2) of BNSS for the offence punishable under Section 4 of the Immoral Traffic (Prevention) Act, 1956 and sentenced the Applicant to undergo rigorous imprisonment for 1 (one) year and to pay fine of Rs.1,000/- (Rupees One Thousand Only) in default to pay the fine, Shantanu S. Dhudum
916-IA-337-2026 (CR).DOC the Applicant to undergo simple imprisonment for a period of one month.

Learned counsel for the Applicant submits that the Applicant has been acquitted for offence of trafficking and convicted only for the offence punishable under Section 4 of the Immoral Traffic (Prevention) Act, only for a period of one year and fine amount of Rs.1,000/-. The fine amount is already deposited. After passing of the impugned judgment in the present appeal, the learned Sessions Judge has suspended the sentence upon an application filed by the Applicant, subject to furnishing the P.R. Bond of Rs.15,000/-, till the appeal period is over.

Taking into consideration the grounds raised in the accompanying appeal filed by the Applicant, and the findings arrived at by the learned trial Court, I am inclined to pass the following order :-
ORDER
I. The substantive sentence imposed upon the Applicant by the judgment dated 29th April, 2026 is hereby suspended, on the same terms and conditions as imposed by the learned Sessions Judge, Sangli vide judgment dated 29th April, 2026.
