IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION INTERIM APPLICATION NO. 338 OF 2026 IN CRIMINAL APPEAL NO. 199 OF 2026 Vishal Arun Alzende ... Applicant V/s.

State of Maharashtra ... Respondent _______________________________________ Mr. Ganesh Bhujbal, Appointed Advocate for Applicant. Smt. Prajakta P. Shinde, A.P.P. for Respondent-State. _______________________________________ CORAM : A. S. GADKARI AND KAMAL KHATA, JJ.

DATE : 23rd March 2026 P.C. :

1) Heard Mr. Bhujbal, learned Advocate Appointed to represent the Applicant. Perused record.

2) It is the prosecution case that, on 19th July 2021, the Applicant, son of deceased Smt. Urmila, demanded money from her for going to work. Smt. Urmila (deceased), told the Applicant that, he was not contributing any amount towards household expenses and on that count, a quarrel took place. PW No.3, sister-in-law of the Applicant was in the house. She heard the noise and came out from her room. She saw that, the Applicant was assaulting deceased with a screw driver. PW No.3 tried to intervene but the Applicant 1/2

DTG 20-Ia-338-2026.doc pushed her and continued with the assault on the deceased. The Applicant has inflicted injuries to the deceased on her chest and neck. PW No. 3 started shouting for help. The neighbours gathered there and the Applicant was apprehended at the scene of offence itself. PW No. 5 saw the Applicant when he was washing his blood stained hands after the incident. 3) Perusal of record prima facie indicates that, the murder of deceased was a gruesome and brutal murder. The Applicant for trifle reasons has committed murder of his mother. Prima facie it appears that, there is sufficient material available on record to indicate that, the Applicant is the author of the crime.

4) In view of the above, at this stage we are not inclined to release the Applicant on bail during the pendency of Appeal. 5) Application is accordingly rejected.
