By this Interim Application, the applicants are seeking return of the amount seized from the applicants.

It is contention of learned counsel for the applicants that the applicants were discharged under Section 109 of Indian Penal Code, 1860 (for short "IPC") and Section 13(1)(e), 13(2) of the Prevention of Corruption Act (for short "P.C. Act").

The applicant had been discharged by the Additional Sessions Judge, Belapur from the charges leveled against him. The said order is confirmed by this Court by order dated 30.08.2024. The amount seized from the applicants is lying before this Court. The applicants needs the
143-IA-517-2026 (CR).doc S.S.Kilaje said amount. Till date no appeal is preferred against the order of this Court and requested to allow the application.

It is contention of learned APP that the Government is mulling to file SLP against the order of this Court and requested to reject the application.

I have heard both the learned counsel. It appears that the discharge of the applicants is upheld by this Court by order dated 30.08.2024, since then no SLP is preferred before the Apex Court. The amount seized from the applicants is lying before this Court. 6.
Considering this fact, I pass following order:
ORDER
(i) Interim Application is allowed.
(ii) The amount of Rs.8,92,320/- with interest if any, be returned to the applicants on undertaking that if required, they may redeposit the amount before this Court as and when required.

Interim Application is disposed of.
