This Application is for condonation of delay of 558 days in challenging the judgment and order of conviction dated 4th June, 2024 passed in Sessions Case No.85 of 2020, whereby the Applicant came to be convicted for the offence punishable under Section 307 of IPC and sentenced to suffer 10 years rigorous imprisonment.

Learned counsel for the Applicant submits that the Applicant is in jail from the date of his arrest i.e. on 31st March, 2020. According to him, even before the Trial Court, the Applicant had no money to engage his own lawyer and was represented by legal aid lawyer.

Learned APP opposes the application. Since the Applicant is in jail and his liberties are curtailed, it becomes by itself sufficient ground for condonation of delay. Hence the Application stands allowed. Appeal be registered. (R.M. JOSHI, J.) 2/2
