The Applicant seeks relaxation of condition (ii) of paragraph 5 of the order dated 29th September 2016. Condition (ii) sought to be modified reads thus: "(ii) After his release from the jail, the applicant shall attend the Bhiwandi Taluka Police Station once in month i.e. on every 1st Monday of the said month between 11.00 a.m. to 2.00 p.m."

Heard Mr. Suraj Gadkari, learned counsel for the Applicant and Ms. Anuja Gotad, learned APP.

Mr. Gadkari submits that the Applicant has been attending the police station as directed by this Court since 2016. He further submits that the Applicant has also been attending the Trial Court on all dates, except when specifically exempted. In support of his statements, he has annexed acknowledgments of his attendance issued by the cooncerned police station for the past few dates.

Considering that the charges are framed, compliances have been made by the prosecution, witness summons have already been issued and the fact that the Applicant is attending the Trial Court on every date, I am inclined to modify the said condition. The modified condition shall read thus:

"The Applicant shall attend the Bhiwandi Taluka Police Station once in every three month i.e. on every first Monday of the third month between 11:00 a.m. and 2:00 pm."

Rest of the order remains as it is.

The Interim Application is partly allowed and disposed of accordingly.
