This Criminal Application is listed at Serial No. 104 on the Daily Board. At the request of Mr. Vikram Chaudhari, learned Senior Counsel for the Applicant and Mr. Anil Singh, learned ASG, these Applications are taken up at 5:40 p.m.

Mr. Vikram Chaudhari, learned Senior Counsel for the
Applicant submits that during the pendency of the Criminal Application No. 1456 of 2025, the Trial Court has passed another Order dated 07.02.2026. He submits that in view of the said Order dated 07.02.2026, the Applicant has filed an Interim Application No. 618 of 2026, seeking an amendment to the Criminal Application No. 1456 of 2025.

Mr. Anil Singh, learned ASG, opposes the Interim Application No. 618 of 2026. He submits that upon passing of the Order dated 07.02.2026, the effect of the Order dated 11.11.2025, which is the subject matter of challenge in Criminal Application No. 1456 of 2025, has become otiose. He therefore opposes the Interim Application No. 618 of 2026. According to Mr. Singh, learned ASG, the Criminal Application No. 1456 of 2025 is rendered infructuous.

Faced with the said objection, Mr. Vikram Chaudhari, learned Senior Counsel appearing through VC on instructions from the Applicant, requests leave to withdraw the Criminal Application No. 1456 of 2025 and the Interim Application No. 618 of 2026, with liberty to file fresh comprehensive proceedings challenging
the Order impugned in Criminal Application No. 1456 of 2025 as well as the Order dated 07.02.2026.

Mr. Anil Singh, learned ASG, does not object to the request made by Mr. Vikram Chaudhari, learned Senior Counsel for the Applicant. However, he reserves the right to oppose such proceedings if filed, on merits as well as on all legal objections available to Respondent No. 1.

In view of the statement made by Mr. Vikram Chaudhari, learned Senior Counsel for the Applicant, leave granted to withdraw Criminal Application No. 1456 of 2025 and Interim Application No. 618 of 2026 , with liberty as prayed. In the event any fresh proceedings are filed, the same will be considered on its own merits and in accordance with the law.
