The Applicant seeks relaxation of condition (v) of paragraph 44 of the order dated 28th July 2024. Condition (v) sought to be modified reads thus:
"The applicants shall not enter the limits of Mumbai, Thane and Navi Mumbai Districts for the period of three years or till the conclusion of the trial whichever is earlier, except for the purpose of attending the proceedings before the Court and marking his presence at the Police Station."

Heard Mr. Rushikesh Kale, learned counsel for the Applicant and Ms. Anuja Gotad, learned APP along with the Investigating Officer.

Mr. Kale submits that the charges are framed, compliances have been made and the recording of evidence has not commenced. He also submits that the Applicant has been regularly attending the police station as well as the Trial Court and has complied with all the conditions imposed on him in the bail order. He states that, for purpose of his livelihood, the Applicant needs to enter the city limits of Mumbai.

Ms. Gotad, however, raises a legitimate apprehension that since the statements of the witnesses have not yet been recorded by the Trial Court, it is likely that the Applicant may intimidate or threaten the witnesses. However, she accepts that the witnesses are in and around Kalyan City. In these circumstances, I am inclined to relax condition (v) of paragraph 44 of the order dated 18th July 2024 to the extent
that the Applicant shall not enter the jurisdiction of the Kalyan Police Station, till further orders.

Insofar as the condition requiring the Applicant to mark his presence at Mahatma Phule Chowk Police Station, Kalyan, on the first Monday of every month, it is also relaxed to the extent that the Applicant shall mark his presence at Mahatma Phule Chowk Police Station, Kalyan on the first Monday of every second month, between 10:00 a.m. and 12:00 noon, till the conclusion of the trial.

Rest of the order remains as it is.

The Interim Application is allowed and disposed of in the aforesaid terms.

The relaxation of the conditions of bail in the present order are only qua the present Applicant.
