This application is for modification of condition No. 3 of Order dated 13th March, 2024 passed in Bail Application 2517 of 2022 whereby the Applicant was directed to attend the concerned police station on the first Monday of every alternate month for a period of three years or till conclusion of the trial, whichever is earlier.

Learned Counsel for the Applicant submits that Applicant hails from State of Jammu & Kashmir and that he attends the hearing before the Trial Court. It is his submission that, if the Applicant is permitted to appear before the concerned police station on the date of which he is causing appearance before the Trial Court, the purpose of the investigating agency will served. 27th April, 2026

Though Learned APP opposed the application, she was unable to give any reason for rejecting the request of the Applicant. Learned APP however, submits that the Applicant be directed to attend DCB, CID on each date of hearing before the Trial Court.

This Court finds substance in the contention of the learned APP that Applicant be directed to attend DCB, CID on each date of hearing before the Trial Court. Hence, following order :-

ORDER

i) Application stands partly allowed.

ii) Clause No.3 of Order dated 13th March 2024 passed in Bail Application No. 2517 of 2022 stands cancelled.

iii) Instead of attending the DCB, CID on the first Monday of every alternate month for a period of three years or till conclusion of the trial, whichever is earlier, Applicant is directed to attend DCB, CID on each date of hearing before the Trial Court. 5.
