The interim application is filed for seeking a direction to discharge the applicant under Section 169 of Code of Criminal Procedure, 1973. The exercise of power of discharge being discretionary, the Superior Court cannot direct the Magistrate to exercise such discretion in particular manner. However, it is made clear that pendency of this petition shall not preclude the Magistrate from passing appropriate order on appropriate application in accordance with law.
