Learned Counsel for the Applicant submits that since the Applicant is in jail he would not have gained anything by allowing dismissal of the application for non prosecution. 4.

This Court finds substance in the contention for the Counsel for the Applicant that Applicant is not benefitted by dismissal of his application for want of prosecution. Hence, 8th April, 2026
