By these Interim applications, the applicant is seeking suspension of sentence and bail.

It is contention of learned counsel for the applicant that applicant has been convicted under Sections 406 and 420 of Indian Penal Code, 1860 (for short "IPC") and under Section 13 of Maharashtra Ownership of Flats and Apartments Act and has directed to undergo two years rigorous imprisonment and fine of Rs.5,000/- in default to suffer simple imprisonment for a period of 15 days. The applicant has paid the

134-IA-937 & 938 -2026 (CR).doc S.S.Kilaje fine amount. During the trial the applicant was on bail and requested to allow the applications.

Learned APP strongly objected to allow the applications on the ground that if applicant released on bail he may abscond and requested to reject the applications.

I have heard both the learned counsel. Perused impugned Judgment and Order. The sentence imposed on the applicant is a short term sentence. During the trial the applicant was on bail. It may take time to dispose of the revision application and I pass following order :

ORDER

(i) The substantive sentence imposed on the applicant is suspended till disposal of the revision application. (ii) The applicant be released on bail on furnishing cash bail of Rs.20,000/- and P.R. Bond of the same amount. (iii) The applicant shall furnish the surety amount of the same amount within one month after released from the jail. 5.

Both the Interim Applications are allowed in above terms and disposed of.
