Learned counsel for the Applicant submits that the Applicant is in jail and this is a sufficient ground for restoration of the Application.

The learned APP opposes the Application.

Since the Applicant is in jail, he would have gained nothing by permitting dismissing the Application for want of prosecution. 5.

Hence, the Application stands allowed.
