By this Application the Applicant seeks modification of condition of bail granted in an offence punishable under the NDPS Act.

Learned counsel for the Applicant submits that the Applicant is a foreign national and hence he is unable to make arrangements for sureties and for this reason, he is in jail. He further makes a statement that the Applicant is ready to pay Rs.50,000/- and on cash bail be be released on bail. To support his submission he placed reliance on Order dated 06.08.2013 passed in Criminal Application No.373 of 2013, Order dated 31.10.2012 passed in Criminal Application No.527 of 2012, Order dated 31.10.2012 passed in Criminal Application No.542 of 2012, Order 21st April, 2026.

At the outset, it is to be recorded that the Applicant is facing serious offence under the NDPS Act. Apart from this, the condition imposed by this Court while granting him bail is not harsh/excessive. The Applicant who is in jail is ready to deposit Rs.50,000/- indicates that this is not a case wherein the Applicant has no help from others to seek sureties.

Having regard to these facts, no case is made out for modification of the bail condition.

Hence, Interim Application stands dismissed.
