By this Application, the Applicant is seeking temporary bail on the ground of medical condition.

It is contention of the learned counsel for the Applicant that, urgent Spinal Cord Surgery is required on the Applicant and her medical condition is deteriorating. Hence, requested for temporary bail for three months.

The learned APP submit that the Applicant be permitted to perform the surgery in Government Hospital and requested to reject the temporary bail.

I have heard both learned counsel. Perused documents produced on record and report submitted by the Chief Medical Officer, Yerwada Central Prison, Pune.

It appears from the report that Spinal Cord Surgery is needed on the Applicant and post operative treatment is also needed. The Applicant has given name of the six hospitals for performing the surgery. 6.
Considering these facts and as the Applicant has needed medical treatment, I pass following order.
ORDER
(i) The Applicant be released on temporary bail for three months in Crime No.573 of 2023 registered with Wanwadi Police Station, Pune on furnishing cash bail of Rs.50,000/- with PR bond of the same amount.
(ii) The Applicant is permitted to take treatment in Jehangir Hospital, (iii) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
