Learned counsel for the Applicant submits that the Applicant was called after a month of his discharge for follow up. It is his submission that the Applicant has undergone open heart surgery and as such he is not fit to be sent to jail. Learned APP placed on record the statement recorded of the Doctor of Nair Hospital, Mumbai intimating that after discharge of the Applicant on 13th April, 2026, he has not visited the hospital thereafter. 1/2

In order to ascertain as to whether the Applicant is fit to be sent back to jail, it is necessary that he is examined by the Doctor at Nair Hospital, Mumbai. The Applicant therefore, is directed to remain present before the concerned Doctor at Nair Hospital, Mumbai tomorrow i.e. 6th May, 2026. The concerned Doctor to submit his report with regard to the fitness or otherwise of the Applicant for being sent to jail. The report be placed before this Court on 8th May, 2026.
