Mentioning is entertained for the reason that the applicant is seeking relaxation of the condition of bail granted to him from 13th May, 2026 to 17th May, 2026 to enable the applicant to attend marriages of his two sisters.

Though, learned APP opposed the application by submitting that the offence registered under the POCSO Act. On instructions she makes statement that marriages of the applicant's sisters are scheduled to be held on 14th May, 2026 and 15th May, 2026. 27th April, 2026.

There is nothing on record to indicate that the liberty granted to the applicant is misused by him. Needless to emphasise importance for any brother to attend the marriage of the sister. The apprehension of the prosecution can be addressed by imposing appropriate conditions.

In view of the above, for temporary period i.e. from 13th May, 2026 to 17th May, 2026, applicant is permitted to enter the jurisdiction of the Byculla Police Station, only for the purpose of attending the wedding at the venue of marriage and to visit his own house, during the said period. Applicant not to contact witnesses in any manner whatsoever.

It is open to the prosecution to move application for cancellation of temporary bail in case any condition is found to be breached.

It is clarified that temporary bail is granted to the applicant only for the purpose of attending marriage of his sisters and the same being not on merit, would not be extended in any circumstances.
