1) This is an Application for modification of condition No. (i) imposed upon the Applicant while releasing him on bail vide Order dated 16th January 2026.

2) Learned Advocate appointed by Legal Aid Committee to represent the Applicant submitted that, the Applicant is behind bars for last about 14 years. That, he has no close relative, who will furnish surety and it is the reason that, though the Applicant has been directed to be released on bail by Order dated 16th January 2026, till date, as he could not furnish 1/2

DTG 2-IA-1150-2026.doc surely, still is behind bars. She therefore requested this Court to permit the Applicant to furnish cash surety for a period of at least four weeks to enable him to search a surety in the said period to comply with the condition No.1 of the said Order.

3) Learned APP submitted that, necessary Order in the interest of justice may be passed.

4) In view of the fact mentioned by the learned Advocate for Applicant, we are inclined to permit the Applicant to furnish cash surety for a period of six weeks from the date of uploading of the present Order on the official website of the High Court of Bombay, to enable him to furnish surety during the said period.
