2) Mr. Garg, learned Advocate appointed by Legal Aid Committee to represent the Applicant submitted that, since the date of his arrest, Applicant was behind the bars and on the date and after pronouncement of the impugned Judgment and Order, the Applicant could not prefer the Appeal within the period of limitation for want of financial and legal assistance.

Sbw 26-ia-1259-2026.doc 2.1) He submitted that, the Applicant thereafter filed an Application with the Legal Aid Committee, High Court, Mumbai. The said Committee appointed him as legal aid counsel. Thereafter, he filed the present Appeal. In the said entire process, the said delay occurred. 3) In view the above, for the reasons stated in the Application and in the interest of justice, delay is condoned and Application is allowed in terms of prayer clauses (a) and (b).
