1) The present Application is made by the Applicant for seeking permission to travel abroad. The Applicant is a senior citizen. Her son and daughter in law lives in the United States of America. The Applicant wishes to visit her son and daughter-in-law in the United States of America. The Applicant contends that the appeal was admitted by this Court on 19th July 2011. She states that since the appeal is admitted, she is seeking the present permission. She states that the daughter-in-law of the Applicant is suffering from serious 1/3
ailments and hence, she wants to visit her son and daughter-in-law to take their care. She states she intends to travel for a period of six months.
2) Learned A.P.P. appearing for the Respondent-States submits that strict condition be imposed in case the permission is given. 3) Heard Mr. Padmasinh Patil, the learned Counsel appearing for the Applicant and Ms. Shilpa G. Talhar, A.P.P. for the Respondent-State. 4) The present appeal is filed by the applicant against the Judgment and Order dated 11th May 2011, whereby the AppellantApplicant was convicted under the provisions of Section 506 of the Indian Penal Code, 1860 to suffer the simple imprisonment for a period of one month and to pay a fine of Rs.200/-. The Appeal was admitted on 19th July 2011. The Applicant's case is that she wants to travel to the United States of America to meet her ailing daughter in law. The Applicant is a senior citizen aged about 63 years old and that she just wants to visit her son and daughter in law. The Applicant is, therefore, granted permission in the light of aforesaid facts and circumstances to travel to the United States of America on the following terms and 2/3
conditions. Hence, the following Order :- : O R D E R :
(i) The Applicant shall furnish itinerary of her travel to the Investigating Officer of the concerned police station.
(ii) The Applicant shall give her cell number as well as the address of the place, where she intends to travel. (iii) The Applicant shall return to India after the expiry of six months and that she will not seek any further extension.
(iv) The Applicant shall report to the police station within one month of her returning back to India.
5) The Interim Application No.1376 of 2026 is disposed off accordingly.
