This is an application for modification of condition No. (ii) of the order dated 15th December, 2025, passed in Bail Application No.4844 of 2024, whereby the Applicant was directed not to be released on bail unless he produces valid passport and visa.

Learned counsel for the Applicant submits that unless the Applicant personally attends the authority issuing the passport, he will not be able to secure National Identification Number (NIN). It is his submission that in such circumstances the Applicant be enlarged on bail without complying with this condition.

Learned APP though opposed the application for modification, however, he was unable to rebut the contention of learned counsel for the Applicant that unless NIN is received, he will not be able to file application for passport. He further does not dispute the fact that for the purpose of obtaining the passport the Applicant has to personally remain present before the authority. 4.

In such circumstances, the Applicant will not be able to secure passport unless he is released on bail without insisting for a valid passport and visa as pre-condition.

Learned APP submits that the condition No. (viii) be complied directing the Applicant to attend ANC, Azad Maidan Unit, on First Monday of each month between 11:00 a.m. and 02:00 p.m. till conclusion of trial.

In view of the above discussions, following order:-

ORDER

i) The Applicant be enlarged on bail without insisting for compliance of condition (ii) of order dated 15th December, 2025.

ii) The condition No. (viii) of order dated 15th December, 2025 be read as under:

"The Applicant shall attend ANC, Azad Maidan Unit, once in a month on First Monday between 11:00 a.m. and 02:00 p.m."

Rest of the order dated 15th December, 2025 shall remain as it is.

Interim Application is allowed in the above terms and is disposed of.
