1) This is an Application for condonation of delay of 382 days in preferring Appeal against conviction.
1.1) Mr. Mali, learned appointed Advocate to represent the Applicant submitted that, since the date of his arrest, the Applicant is behind bars and on the date of his conviction for want of legal and financial assistance, he could not prefer Appeal within the period of limitation. That, the Applicant subsequently sent a letter to the Legal Aid Committee, High Court, Mumbai and in pursuance thereof, he has been appointed to represent the Applicant/Appellant.

3) In view thereof, for the reasons stated in the Application and in the interest of justice, delay is condoned and Application is allowed in terms of prayer clauses (a) and (b).
