Interim Application No. 1723 of 2026 filed by the applicant/appellant seeks condonation of delay of 214 days in filing the appeal, being aggrieved by the judgment of conviction passed by the Additional and Sessions Judge, Borivali, Dindoshi, Goregaon (East), in Sessions Case No. 19 of 2015, thereby convicting him and sentencing him to life imprisonment under Section 302 of the IPC. 2.
Heard Ms. Gonsalvez for the applicant and perused the application, which has clearly set out the grounds for the delay, the primary ground being that he was in custody since 2014, i.e., from the date of his arrest, and he faced difficulty in engaging a counsel to file the appeal, apart from the fact that he also belongs to a lower socio-economic strata and received no assistance from the family Ashish

We find the justification offered to be bona fide and, hence, the application is made absolute in terms of prayer clause (a). 3.
