This Application is filed under Section 11(6) read with Sections 14 and 15 of the Arbitration and Conciliation Act, 1996 whereby the Applicant has sought the substitution of the learned sole Arbitrator who was appointed in the matter pursuant to an Order dated 2nd April 2025 passed in Arbitration Petition No. 107 of 2025.

Ms. Rohira, learned Advocate appearing on behalf of the Applicant submits that the parties had appeared before the learned 1/3

Arbitrator. However, given the quantum and nature of the claim, the fees suggested by the learned Arbitrator was not agreeable to the parties. Hence, the learned Arbitrator by an email dated 25th August 2025 indicated her disinclination to enter reference as an Arbitrator. I am informed that the quantum of dispute as far as the claim is concerned is approximately Rs. 15 Lakhs plus interest. Clause 14 of the MOU provides for arbitration and there is no dispute that the Applicant has already invoked arbitration by its notices dated 3rd April 2024 and 9th May 2024. There is no denial of the arbitration clause or the invocation by the Respondent. 3.

In these peculiar circumstances, the Arbitration Application is allowed in terms of prayer clauses (a) and (b) and Mr. Devansh Shah, learned Advocate of this Court is appointed as a sole Arbitrator to continue with the arbitration proceedings. The parties are permitted to complete the pleadings in the Section 9 Petition which is now converted into Section 17 Application and the same shall be adjudicated by the Tribunal on its own merits.

The learned Arbitrator shall comply with all the directions already recorded at paragraph 4 of the order dated 2nd April 2025 to the extent applicable.

All issues on merits are expressly kept open to be agitated before the Tribunal now appointed. Arbitration Application No. 122 of 2026 is accordingly disposed of.
