The learned Senior Counsel appearing for the Petitioner stated that he has instructions to withdraw the above Writ Petition because the present Petition challenges the order passed by the Assessing Officer rejecting the application for stay of demand. However, PCIT has subsequently passed an order rejecting the stay on recovery of demand for Assessment Year 2017-2018 for which a separate Petition is filed by the Petitioner. In other words, nothing survives for consideration in the above Petition.

Considering the aforesaid circumstances, the above Writ Petition is dismissed as withdrawn. No order as to costs. 3.
