Heard learned counsel for the parties.

The petitioner is an education society, alleges inaction on the part of the respondent No.1 - Mumbai Municipal Corporation to act upon the petitioner's complaint dated 6th February 2026. It is the grievance of the petitioner that on or about 20th August 1964, the Corporation approved a plan for respondent No.3-Society and in the said approved plan, plot of land bearing CTS No.43 is shown as an area reserved exclusively as a children's playground. On or about December 2025 and January 2026, the petitioner noticed
that the respondent No.3-Society is wrongfully and illegally converting the plot of land bearing CTS No.43 into a parking area which area is reserved exclusively for playground area. Learned counsel for the petitioner relied upon the photographs to demonstrate the illegality. Learned counsel for the petitioner relied upon the copy of the block plan received through an RTI which discloses that the plot of land bearing CTS No.43 is reserved for children's playground. Learned counsel for the petitioner filed a detailed complaint dated 6th February 2026, pointing out the said illegalities.

If the complaint made by the petitioner, that the plot of land which is reserved for a playground is in fact used as a parking area has any substance, then the matter is very serious. The concerned Officer of the Corporation must make a necessary enquiry by looking into the allegations in the complaint dated 6th February 2026.

We have heard learned counsel for the Corporation. The present Writ Petition can be disposed of by directing the Ward Officer, BMC, K/East Ward, Azad Road, Gundavali Gavthan, Andheri (East), Mumbai to immediately look into the complaint
dated 6th February 2026 addressed to him and which is at page 33 of the paper-book of this Writ Petition and after making the necessary enquiry, if necessary by hearing the petitioner and the respondent No.3, proceed to take appropriate action in accordance with law. The complaint be looked into expeditiously and in any case within a period of eight weeks from the date of communication of this order. The petitioner undertakes to remain present before the Ward Officer, BMC, K/East Ward,on 17th March 2026 at 11:00 a.m.

The Writ Petition is disposed of.
