At the outset, the learned counsel for the Petitioner Bank (secured creditor) submits that the petition will have to be amended in the light of certain facts that have come to the notice of the Petitioner, including the fact that the National Company Law Tribunal, Mumbai (NCLT), has declined registration of the company petition filed by Respondent No. 3. It is submitted that the petitioner desires to also challenge the order passed by the Debt Recovery Tribunal (DRT-II), Mumbai, in the context of the aforementioned fact that has come to light recently. 2.
Since we are at pre-notice stage and the proposed amendment would assist this Court in disposing of the writ petition, in the interest of justice the Sweety

List the petition for further consideration on 17th April 2026 in the fresh category.

Respondent No. 2 has appeared through counsel and prays for permission to file a reply affidavit.
