1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Dr. Bharat Govind Naik being Executor named under the Will of deceased. The deceased namely Jnaneswari Govind Naik died at Panvel, Raigad on 18.02.2025. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.
2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 08.05.2009. The said Will is in Marathi language and official translation of the said Will received from the office of Chief Translator, High Court, Bombay uploaded separately through e-filing. The Para No. 4 of the Will refers to the appointment of petitioner as alternate sole Executor under the Will. Primary Executor namely Govind Naik died. The property mentioned in Schedule I annexed to the petition is referred in para No. 6 of the Will.
3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased is survived by three sons and one married daughter. Out of them one son is petitioner herein and who all have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.
4. Petitioner's oath is filed. Affidavit of Vishwas Jaywant Varde dated 13.01.2026 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 25.02.2026 is filed. All other legal formalities are complied with. Hence, petition is granted.
5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
